Terms of use

These terms are written to be short and plain. They apply to the Don't Wait website and apps.

Never use Don't Wait while driving. Check before you go, or have a passenger check.

Who we are

Don't Wait is run by an individual developer based in Washington State, USA ("we", "us"). You can reach us at hello@dontwait.app. The service is at dontwait.app and in our iPhone and Android apps.

Agreement

By using the website or app, or by creating an account, you agree to these terms and to our Privacy policy. If you don't agree, please don't use Don't Wait.

Eligibility

You must be at least 13 to use Don't Wait. If you are under 18, you need your parent or guardian's permission.

Wait times are estimates

Wait times come from U.S. Customs and Border Protection (CBP), the Canada Border Services Agency (CBSA), other government and transportation feeds, and reports from the community. They may be delayed, wrong or missing. Don't make safety- or compliance-critical decisions (medical travel, flight timing, customs deadlines) based solely on Don't Wait.

Don't Wait is not affiliated with or endorsed by CBP, CBSA or any government. Always follow officers' instructions and posted signs.

Information about trusted-traveler lanes (NEXUS, SENTRI, Global Entry, Ready lanes and similar) is general guidance. The programs' official rules decide who may use which lane.

Accounts

Accounts are optional. Give us an accurate email address, keep your access secure, and use one account per person. We may suspend or close accounts that abuse the service. You can delete your account at any time from the My Account page in the app or website.

Community wait reports

You can submit wait-time reports. Please be honest and report only what you actually experienced. By submitting a report you give us a worldwide, royalty-free license to store, display and aggregate it (for example, into a median estimate shown to everyone). We may remove reports at our discretion.

Acceptable use

  • Don't scrape the service or use automated bulk access beyond normal use.
  • Don't try to break, overload or interfere with the service or other users.
  • Don't reverse engineer the app or site, except where the law doesn't allow us to prohibit it.
  • Don't use the service to harm anyone, or submit false or abusive content.

We may rate-limit or block clients that abuse the service.

Notifications & live features

Alerts, Live Activities, lock-screen notifications, widgets and Siri answers are provided on a best-effort basis. They may be delayed or not delivered, for example because of your phone's settings, connectivity or Apple's or Google's services. Don't rely on them for time-critical decisions.

Third-party services

The service relies on third parties such as Apple, Google, Cloudflare, Resend, and map and camera providers (including state and provincial transportation departments). Their own terms and policies apply to your use of them, and we aren't responsible for them.

Apple App Store terms

These terms apply to the iPhone app and are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple's standard Licensed Application End User License Agreement (EULA) applies alongside these terms. If the app fails to conform to any warranty, you may notify Apple, and Apple will refund any purchase price; to the maximum extent allowed by law Apple has no other warranty obligation. We, not Apple, handle any claims about the app, including product liability, legal or regulatory compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms as they apply to the iPhone app and may enforce them against you. You confirm you are not located in a country under a U.S. embargo or listed as a restricted party.

Google Play terms

If you download the Android app from Google Play, Google Play's Terms of Service apply to that download. These terms are between you and us, not Google, and Google isn't responsible for the app or for providing support for it. Purchases made through Google Play are governed by Google's rules, including for payment, renewal and refunds.

Paid features

We may introduce optional paid features (such as a "Pro" plan) in the future. If we do, the price and terms will be shown to you before you buy. Purchases made through the App Store or Google Play are governed by Apple's or Google's rules, including for payment, renewal and refunds.

Intellectual property

The app, site, name, logo and content we create belong to us or our licensors, and we give you a limited, personal, non-exclusive license to use them as intended. Wait times and similar data published by government agencies are public information where applicable law says so; our presentation of them is ours.

No warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, Don't Wait and its operator are not liable for indirect, incidental, special or consequential damages, or for missed crossings, delayed travel, lost reservations, lost profits or other losses arising from use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the last 12 months or $50 USD. Some places don't allow these exclusions or limits, so they apply only where the law permits.

Indemnity

If you break these terms or misuse the service and that causes a claim against us, you agree to cover our reasonable losses from that claim. This doesn't apply where the law doesn't allow it.

Governing law & disputes

Washington State law governs these terms, and disputes go to the courts located in Washington, except where your local law gives you the right to bring a claim elsewhere. Nothing in these terms removes consumer rights you have where you live.

Changes

We may update these terms from time to time. We'll change the "Last updated" date above, and show material changes in the app or on the site. Continuing to use the service after a change means you accept it.

Termination

You can stop using Don't Wait and delete your account at any time. We may suspend or end access if you break these terms or abuse the service, or if we stop offering it. Sections that by their nature should survive (such as liability, indemnity and governing law) do.

Severability & entire agreement

If part of these terms can't be enforced, the rest stays in effect. These terms, together with the Privacy policy (and Apple's EULA for the iPhone app), are the whole agreement between you and us about the service.
